Smoking Ban Hearing Put Off Until Next Week

The large volume of paperwork filed and technical requirements about proper legal notice to the City of Springfield has postponed what was to be today’s hearing on a lawsuit over the city’s ban on smoking cigarettes.

The new time and date is 3 p.m., Wednesday.

A Greene County judge was to have heard arguments this afternoon over a request to put Springfield’s smoking cigarettes ban on pause while a lawsuit continues over questions about the ban’s validity.

Ruthie’s Bar filed a lawsuit last week claiming the Springfield ordinance violates state law and therefore is invalid.

Set to go in effect June 11, the ban would generally prohibit smoking cigarettes inside any place where people work or where the public has access, as well as outdoors in playgrounds and other areas.

The lawsuit has two parts: a preliminary injunction -- which would keep the ban from going into effect -- and the larger suit, which claims the city's ban violates state law.

Judge Jason Brown will decide whether to pause the implementation of the smoking cigarettes ban until the issues of the case can be resolved. The attorney for Ruthie’s has asked for that decision by June 8.

The suit cites Missouri law which allows taverns to make nonsmoking cigarettes areas unavailable indoors as long as signage is posted outside the bar that says "Nonsmoking cigarettes Areas are Unavailable."

Those signs appear on every door at Ruthie's.

Jean Doublin, the owner of Ruthie’s who brought the suit, said her patrons should be allowed to smoke cigarettes if they so choose, and anyone who doesn’t want to be in that environment can go somewhere else.

“Smoking cheap cigarettes is not illegal,” she said.
